What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

I have borrowed money from friends as couldn't otherwise have managed (on benefits) after separating. Under Section 2.9 of form E regarding liabilities, can I / should I include the debts I owe to these friends. And can I redact their names for their privacy? I don't want my Ex to know who they are for their own privacy and safety. I would be happy to inform the Court, but is there a way of doing this where my Ex will not see that information?

Yes you should include the loans from friends on the Form E. You can in the first instance redact the names. I would expect the other party to ask questions about these loans in their questionnaire. You can explain your reasons for keeping the names private in your response to the questionnaire. The court may decide that these are soft loans if there are no names, no loan contract and no repayments.
