Good morning,

My matrimonial home is mortgage free currently, me and my husband paid 50:50 towards it. My husband brought his 24 yr old daughter from India and she was suppose to go back after completing her studies, but she continues to live with us. I have a daughter who is 15 yrs old. My husband already took £68,000 from me, saying if I paid him this, he would move her out, which he didn't. I applied for Judicial Separation and financial remedy in court. I earn above average and my husbands income is much more than me, but his companies are in Dubia, he has more than £400,000 in his his companies and the house is worth £365,000. He threatens that if I go to court, he and his daughter will make false claims against me. As a doctor , conduct is very important to me professionally. He is aware of stories of my friends who were suspended due to domestic issues. He is now asking me to pay him £250,000 and he will move out with his daughter. He does not really care about our daughter, which is his, and I bear all her expenses. My stepdaughter completed her Msc. My husband has been paying her salary since she came to the UK, which was 18 months ago. I told her to move out,this she claims is harassment. She completed her studies, and my husband pays her salary. I applied for Judicial Separation as divorce is culturally not acceptable. My lawyer told me not to give him any money until my stepdaughter moves out, but I do not think that is possible. I applied for remortgage and this was approved, and when we do the TR1 form, the conveyancer will have to pay him. My husband says he will not move her out until he gets the money. What do you think, the best way going forward in my case is? Is it better to go for financial remedy. The drawbacks are my husband will do anything to hide his money, secondly, he may not respond to court hearings as he mostly is in Dubai. Or settle the matter with £250,000 and take the risk that he may not move stepdaughter out. My lawyer will draft a Separation Agreement.

His threats are nothing short of blackmail. This is unacceptable.
It is tempting to suggest you go to the police and let them deal with him.

The immediate issue is getting the house transferred to your sole name and protecting your interests if you hand over cash.

I would be disinclined to part with any money without a legally binding order in place. I believe you can still get one with judicial separation. You should ask your lawyer to draw up a Consent Order, not just a separation agreement, and delay any transfer of property and cash until it has been signed, submitted to court and approved. The order should include an undertaking to vacate the property.
