What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

I have filed for divorce and we have mostly agreed finances, the main part being a sum for equity in house.
I know we have to wait the 20 weeks until filing the Consent Order but I need to start looking for my new home in the mean time.
Should i want to make an offer on the property how can I show proof of funds (part mortgage but the deposit will be from above), this is something some estate agents have asked for before even viewing a property.
I don't want to wait until the consent order is filed to start looking as house sales take time and I fear once the financial consent order is done ex would want me out of the house asap.
Ideally I want to be in a position to ove out as soon as money is transferred.

There's nothing to stop you getting the consent order drawn up and signed so it can be submitted as soon as you have a date for conditional order. If he has a mortgage in place to buy out your share that, with the draft CO should show you have the funds with a mortgage to proceed with a purchase. As you rightly say it takes a while to buy a place so it's worth starting to look now. Do you have the funds to pay for a survey?
