What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Hi,
I've recently applied for a Clean Break Order. The Court has responded with the following:
=1.2rem"There is no date set in the order for the payment of the lump sum and the transfer. If the transfer has taken place this should be recorded."
This is in relation to me being brought out of the main property, and the transfer happened a couple of weeks after the CBO was applied for.
We have been sent a cover sheet with a reference number on it to be sent off.
My question is, can we just respond with a document signed by both parties to state the the transfer has happened in the CBO, or do we have to submit a new CBO with updated financials?
Thanks.

You may need to make a slight amend to the CO and send the new draft with a covering letter of explanation.
If you have had the Consent Order drawn up by a solicitor they should really address this again no further cost to you.

Thanks hadenoughnow - It was drawn up by an on-line service that aren't replying to my emails regarding this. I'll draft a suitable response and send it back with their cover page. I'll respond to this thread as things happen.
