Would a court entertain a D11 applicstion for a respondent to disclose their partners significant cash or property assets, if the respondent had stated in writing their intention to jointly buy property with their partner and the parters asset therefore had a bearing on the reapondents need?
In this case the applicant has obtained (via open source) information and documentational evidence of the asset, but the respondent failed to include it on form E (purposely as they tried to hide it) and has refused or ignored several requests to disclose since. Throughout the proceedings the respondent has not included the partners assets in their needs assessment but quite obviously the partner will use their money towards the property they buy with the respondent and therefore reduce the mortgage need (and probably mean a mortgage is not required at all). Case is due for FH soon.
