My divorce is at the Decree Nisi stage, my ex and i still share the same house with our daughter even though we have been separated for 5 months. Life is becoming increasing difficult, rows are frequent and its not helping my little girl so one of us has to move out. Ex won't move out as he doesn't want the divorce anyway, he can't afford to buy me out and if we sell it neither of us will get enough to start over.
Does anyone know if i can claim housing benefit or LHA if i move out? Both names are on the mortgage so does that mean i can't apply for a council property? Feel like i've not been able to move on in all these months and i don't seem to be able to get a straight answer from anyone i speak to at the council etc? Solicitor tells me to stay put in the house but life is unbearable now and mortgage company won't let me take it over as i don't earn enough. Any advice would be much appreciated.
