My stbx get all the benefits and DLA for my son. When we sell the house and go our separate ways I have shared residence, every Wednesday overnight, alternate weekends and half of school holidays.

My question is does my stbx share the dla care with me (proportion)?

Also if I pay hal of everything for the children, should some of the child maintenance be offset against this?

Unfortunately benefits for one child can''t be split. The Government says administratively it is too complicated and expensive.

As far as child maintenance is concerned parents can come to any family based arrangement they want and in a case like this it makes sense to come to an arrangement that meets the needs of your child.

Under CSA rules the paying parent ( the parent with less childcare) pays a percentage of their income minus deductions for any over night stays and it may be possible to apply for a downwards variation if you incur special expenses related to contact. It is then entirely up to you whether you pay more.

On the other hand, depending on the circumstances, your ex may be able to make a claim through the courts under the Children''s Act 1989 to help with expenses related to your child''s disability.

how many children do you have and is she refusing to share the benefits? Does your ex work and do you work? if so, are you employed or self employed?
