Hello, my stbx has moved in with another woman and her children, does that mean he has to pay less child maintainence as he is "supporting" her children? Even though she is a wage earner and receives child maintainence from her x?

And when considering child maintainence can her income be taken into consideration?

Im pretty surethat he will pay slightly less. The best thing to do is phone the CSA and check, but if she has two children he can take 20% off of his net income before your child maintenance is calculated. I hope this helps.

But she receives money for those children from her ex and their wages together with her payments from her ex total £5,000 per month NET

By the way, her income cannot be taken into account when working out your maintenance but if hes a high earner you should still get a decent amount.

yes but according the csa website his payments will drop by 120 per month because of her kids.... even tho she receives £400 per month from her x for them

The basic calculation for NRP to pay would be based on his net income, minus an allowance of 15/20/25% for 1,2,3 child(ren) respectively living with him, plus Working Family Tax Credits if he earns more than his new partner. Child support would then be payable at 15/20/25% of that figure for 1,2,3 child(ren) respectively .

eg both NRP and PWC households with one child
NRP net income £400 - 15% (£60) = £340
+ WFTC £100 = £440
15% = £66/week
