I would be grateful if anyone could assist.
my husband pays child maintenance from a Consent Order from Oct 2002 for his 2 children who are now aged 18 and 15, the order states: Payable until each child attains the age of 17 years or ceased full time education for a trade, training or profession. his oldest is going to uni this September, does he still have to pay maintenance for him while he is at Uni and at what age would maintance cease. Would he be better off applying to the Courts again to go through the CSA? Many Thanks in adavance.

He will have to go through the courts as the CSA will not get invoved in cases predating March 2003.

The wording of the consent order is not clear as it includes trade or training but not specifically university.

There are quite a few posts on this subject so it's worth having a look in the forums. It is a contentious subject.

If your husband is on speaking terms with his ex they could come to some further agreement either to extend the consent order for both children or they could make an arrangement where he supports the child directly (the child still needs somewhere to come home to during the long holidays so the mother still needs to house and feed him!)

In my case I have a court order that has recently been extended for all 4 of my children to receive maintenance (via me) until they have finished a first degree, although not for any gap year, but that was because he does not have contact with three of them.
