What can the parent with care do to meet the cost of living if a child support order is not being met. Can they apply for income support?

I presume you have gone through the CSA with no luck.

Indeed you can claim income support as you need money to live on.

I don't think CSA can get involved. The order has just been made - CSA can only be approached after one year of the order being made plus there is only so long someone can live on an overdraft and I think they would take far too long to sort something out.

If there is an agreement for child maintenance documented in a Consent Order you can apply to the court for enforcement. The easiest ways to do this is to register the order with the magistrates court and apply for an attachment of earnings. See the 'form' EX327 available to download from HMCourts website.

Thanks Angel and Fiona

It appears that the ex may be in between jobs - would an attachment of earnings be appropriate in that case?

These court measures could take months - presumably an income support application would be appropriate until the payments are up and running again?
