Hi

back again after quite a while away from the site. Thought everything was running ok then it`s all turned a bit nasty of late, ex`s grr!

Anyway divorce and Consent Order granted end of October 2008. It was ordered that he pay £250 per calendar month for our child. If he neglects or refuses to pay this was action can I take to enforce it? Or would it then be in the hands of the CSA?

Since 2003 normally the CSA has jurisdiction and CM can only be agreed in a consent order and not ruled by a judge. In this situation you can ask the court to enforce arrears, although either party may ask the CSA to become involved one year after the dote of the consent order and the order should cease to have effect.

However, there are circumstances when the courts have jurisdiction and the CSA cannot get involved - when there are step children, over 18s in education and when one parent lives abroad.
