My wife has applied to the courts for an extention of term to first degree.
Her ex is high earner and the children currently go to an expensive private school he pays for.
However at the time of the Consent Order he refused to officially agree to tertiary and now is adament not to.
anyone know what the courts views are currently on this stuff.

thanks

There is a long line of authority that children over 18 in education or training are entitled to financial provision for their education when parents can afford to contribute. However, the father is likely to argue the finances were settled and he shouldn't be subjected to another attack. The problem with this is unless an agreement can be negotiated often the legal costs cancel out the value of any maintenance awarded.
