I have recently seperated from my wife. We have been living in France for the last 7 years, although I have been coming back to work and paying my tax in the UK. We have been receiving tax credits in the UK as is our entitlement . Will I still be able to claim this even though we are soon to be divorced and the children residing in France?

Hi Joey,

Child Tax Credits are only payable to the parent with care. Do you or your ex claim Child Benefit?

Does your ex work? The question would be if your ex is a resident of another country and does not not work and pay UK taxes- would they still be entitled to Tax Credits.

If you are over 25 and work more than 30 hours a week - then you would be abloe to make a claim for working tax credits in your own right. Any award though would depend on any income.

My x is receiving child benefit in France.

She recently lost her job and is claiming unemployment benefit in France. The 4 children live with her and I plan to have them for 84 days per year.

We have agreed maintenance at 1,000 euros per month 60% of which is met by the tas credits.

Unless the Child Benefit was in your name, you will not be able to claim Child Tax Credits.

The 84 days will only come into play for any child maintenance claim that may be made.

I am not sure about her right to claim tax credits whilst claiming unemployment in another country.

This is one that definitely needs to be put to HMRC Tax Credit Helpline 0845 300 3909.
