I am in the process of a divorce ( I am Divorcing her) this has been accepted by the courts.
my wife has asked the CSA to collect monies for our 2 children,
she has the children living with her ( I want Joint Custody But have knowere for them to stay untill finacial things have been sorted, she works part-time and has the house with no mortgage to pay, I do not work and haven't for 3 years due to ill health, for the 1st year my wife supported me due to not being able to claim DSS.
when the children are off school due to illness or holidays my wife expects me to look after them, feed them and run round for them while she works but she wount let me in the house to look after them, I don't mind doing this for my kids.
I only recieve invalidity benefit & mobilty benefit, I have to pay rent,Etc, and finding it hard to make ends meet, feed myself or put fuel in the car, anything I did with the children has now stopped due to lack of monies.
Can I counter claim with the CSA against her?

No only the primary carer can claim (generally the parent receiving child benefit), however your contributions should be reduced by 1/7th for every night of the week they stay with you.

As far as I am aware the PWC (parent with care) has the childen staying overnight with them is the one entitled to CSA...you may get the answer at www.csa.gov.uk
