Ive been through my Consent Order and thers no mention of a variance. Dioes this mean I cant ever apply for a variation or can i argue the case that this was based on the time i had the children at the time of the divorce. As my circumstances have now changed can i vary...without it being in the consent order ?

I went to see my sol yestaerday and she said just go CSA and pay what you are required to by law then you have the leeway to provide for your children if ex isnt doing her bit so that me down the road to the CSA methinks.
As it is I have already agreed to pay all extra curricular and half of school trips.
As already discussed in this thread she said even if the other party wont co-operate you dont need them to. The CSA give the other party a time period to complete the documents then if they dont co-operate they act on the information they have. I will have to keep making the consent order payments until the assesment is made though :-(

How did it go with the CSA?
Just trying to decide whether to put CM in our consent order or go through CSA, have "private agreement" at the moment (below any CSA assessment!!)

Miffy

I went to CSA and asked them to start the process and meantime advised ex of how it was panning out. She responded saying it would cause hardship if I dropped to the CSA minimum. I had already decided that was on the low side so I made made her an offer of 15% more than the CSA assesment. She accepted that so I am proceeding with a CSA assessment just to get the numbers confirmed and they will advise the us and the court so we have the minimum value established which effectively varies the consent order. Quite painless really
