Hi,

My step-children visit regularly and my husband is very responsible about CSA (20% of his income) and spousal maintenance (SM) payments. Unfortunately he was made redundant over six months ago. It's been a struggle, but we've managed to keep paying SM out of my income and we've contributed his Job Seeker's Allowance (c. £65pw) in lieu of CSA. As he has £0 income, his CSA is the min. £5 per week, so we've been as generous as possible. I've also been paying for petrol so he can pick up/return the children, as well as paying for food and birthday gifts. After our mortgage, bills and the above, there's not much left!

Ex-wife has been ok so far, but as time goes by, step-children's visits have been cancelled and there has - understandably - been complaints that money is tight. Unfortunately the children have made comments that indicate their mother feels we are 'rich'.

My husband is doing everything he can to find another job but it's difficult. I'm worried about the added stress the ex-wife is putting on him. Does anyone have any experience of this? I'm worried about having my income being considered by CSA as we couldn't afford 20% from my salary!

Children are all at school and ex-wife works part-time. Are there any extra government or charity benefits that could help her/the children?

Many thanks.

You are not responsible for his children, and the CSA will not count your income when deciding what needs to be paid.

I don`t know anything about benefits but i hear the cab are very helpful.

Hi

Welcome to Wiki.

Your salary isnt taken into consideration when the CSA make thier calculations - as it is the non-resident parent (your husband) who is responsible for providing financial support for his children.

Is the children's mother claiming the benefits she is entitled to, ie Child Tax Credits, etc? The CAB have benefit advisers who help make sure that those entitled claim the benefits they are entitled to.

Its worth noting that contact and child maintaince are two separate issues.
