My husband and I have been separated for 3 years, not divorced. We have a daughter of 5 years, he is english and I moved abroad to my country once we separated (i am not english) and am living with my daughter. She just started school and it is getting very hard to pay for her expenses. I have never asked him for any money before nor has he sent us any. he has visited her once since our separation. Do you think I am entitled to of child support? Please help...

I hope others with experience of this will reply, but just to get the ball rolling:

The CSA in England does not have jurisdiction. You will need to get the child support agency in your home country to take action, and it should then be possible to enforce that in England.

Alternatively you can go to court in your country to get a court order for child support which will then be enforced in England via the REMO scheme (Reciprocal Enforcement of Maintenance Orders).

It is difficult to give more advice without knowing what country you are in, but I understand if you don't want to reveal that.

Firstly, before you go the court route, have you tried talking to him and coming to an agreement re. CS ? And contact?

You can only go thru REMO if you are in a REMO country - the CSA website has a list.

Otherwise it gets complicated, going thru courts in two countries.

Did you just leave or did you apply to UK courts for Leave to Remove? Did your ex consent to the move?

My country is not listed for REMO. I dont think it is possible for us to get into an agreement because he doesnt earn as much money, but I am paying for schooling and bringing my daughter up on my own on a third world country wage!! So I dont expect too much, just some financial help. Do you think contacting the UK embassy here would help?

PS: How does it affect having a Leave to Remove order from the UK courts? Actually we did leave without consent after a very bad fight. But we are OK now and he can visit whenever he can.
