my ex didnt pay maintenance in November, he said he couldnt afford it and would give it back when he could. I still have not received the money, can anyone tell me if I can still claim it back. The original order was agreed through solictors, drawn up and stamped under a court order. Wpuld it cost more to try and re claim the money, and how do I go about it.

Thanks

Depending upon how much maintenance you receive from your ex, it would probably cost more to take it back to court than you would actually receive...although saying that you might be able to claim for costs too...maybe have a chat with your sol?

Did your ex give you any reasons as to why he missed the payment? I can quite understand being strapped for cash in the run-up to Christmas (not that this excuses the lack of maintenance), but often maintenance is a very worked out exact science, with the NRP often not having very much leftover at the end of each month. He therefore might be struggling to get the cash together to pay his "debt" in full all in one go.

Have you tried suggesting that he pays an extra £50 each month until the debt is cleared?

Or, as a thought, if you managed to get by and don't need the money as such, could you maybe let it slide, just this once, as long as he makes all future payments on time? It might help to keep things amicable.
