CSA talk rubbish im sure

i have 2 kids with previous relationship and 1 with my now divorcing wife, i phoned the CSA to say that with the 1 child we have a private maintenence agreement as promoted by the CSA, they now tell me that this doesnt affect my maintenence payments BUT it was them who promoted this, what steps do i take next as living on £80 per month is a struggle

I wouldn't rely on 'phone calls - get everything in writing (both what you say to them and any reply). The CSA are hopeless.

My understanding is that you have a private agreement or pay through the CSA?

In this case I don't think there is any point in writing as I believe the information is correct and it is a loophole when the CSA are dealing with children from first and second families.

The remedy is to apply through the CSA to pay child support for all the children.

I agree. You need to contact the parent of Child 1 and say that it is necessary for her to apply for maintenance via the CSA. This would mean your overall csa liability would be 20% minus any shared care. Once the assessment is in place there would be nothing stopping you paying the parent of Child 1 directly if that's what you both wanted.
