Hi,

can someone please tell me,

if a County Court mainteance order is revoked in the court it was first made in, does this mean that the order is completely discharged and I can never go back to the court to apply for variation.

Does it mean if I ever want maintenance in future I have to reapply to the court from the very beginning?

Since March 2003 the CSA usually has jurisdiction and the courts have no powers to impose an order for child maintenance or a variation, or revive an order. The CSA has no jurisdiction and the courts can make an order when the children concerned are step children, one parent lives abroad or for over 18s in education.

I need to know if revoked means "discharged".

ie there is absolutely no order that can ever be resurected again if circumstances change etc?

I live abroad not under csa jurisdiction and the court order was made at the time of our divorce 10 years ago. I can go through a foreign court if the original uk order is not in existence anymore.

My ex had the order revoked yesterday in court (I did not fly over to attend) so dont know what was said.

But we both wanted it discharged, and im unsure as to whether the revocation means the order is still in existence preventing me from applying elsewhere.
