my partners kids are 20 and 17 both work part time the eldest is at uni the youngest college but going to uni next year.will my partner have to pay maintanance for both of these even though they earn and have lives of their own but still live with their mother.she says he has to pay for both of them

When there is final court order settling the finances it will depend on the exact terms. If there is no court maintenance for over 18s in education may be included in the overall settlement or children can apply for maintenance from separated parents in their own right. The consideration is the needs of the "child" plus their resources and the resources parents have available to meet those needs.
