Would anyone know the ruling on this?

I have outstanding CSA debt to my ex-wife of £1500. She has lived in France for the last 3+ years. Do I legally still have to pay this debt? Can the CSA still enforce this debt for her even though she has been out of their jurisdiction for more than 2 years? My daughter is almost 16 and I would prefer to pay any monies directly to her, as I feel she will spend this money more appropriately than her mother!

I would hazard a guess at no, they won't necesssarily write it off.

Was your ex at any point on benefits? If so, a portion of the debt would be directed towards a government pot, rather than your ex. If this is the case, can't see them letting it go.

If it is soley for your wife, I assume that if she was resident in the UK for the period of time the debt relates to, they can still chase you for it.

Have they chased you for it? If not, it is perhaps an indicator that it's lying dormant precisely because your ex is out of their jurisdiction and/or because your ex isn't chasing them. In my experience, the CSA do nothing at all until asked about 25 times, and only then if you make an official complaint!

All that of course is logical and there is little logical about either the CSA or the Law in my view!

Yes she was on benefits. Original debt was over £8,500 5-6 years ago. Case closed when she left. I continued to pay at a lesser rate(£200), I stopped July 2010, they are pursuing me with a CCJ, obliviously my ex has given instructions to do so!

I have asked them to reconsider and they have responded by asking for evidence that she has no intention of returning to the uk!!

Any ideas?, again I would point out that The Money is not the issue - I have always been involved directly for my children but prefer to have the direct influence with them and make sure that monies are appropriately spent!
