Hi There.. I am new on hereim from SA, needing some urgent advice on my situation: I moved out from living with my husband a week ago as i could not take living in a bachelor flat on his fathers property anymore with all the arguing and bad vibes, we needed our own space. My husband was not happy that we were moving, he was supposed to move with us but he didnt and when it got to the day of moving him and i got into an argument, i mentioned that if he does not see his son or pay towards what is needed for him i will take him to court for maintenance. He then got on the phone with his mother who is now threatening to take my son away as she says she has the resources and finance to do it. I just want to know what my rights are as a good mom, my ex's mother does even know my son, she does not visit him or see him in months, we only see her on speacial occasions such a christmas. She does not know where he goes to school or how he is. She doesnt know him at all yet now she is trying to take him away from me becausee her son is upset im going to take him to court for maintenance. I have a nice 1 bedroom ground floor apartment with a garden and have absolutely everything my son needs, I am home with him everyday and every weekend unless he goes to play by my mother, who he loves!! Please could someone shed some light on this situation of mine as i dont know where to turn. I dont receive any money from my ex and earn just enough to pay ALL the bills and put good meals on the table so i cannot afford a lawyer.

Hi Kayleigh,
Welcome to wiki. I'm sorry to hear that you're experiencing this. I don't have young children but others who have fought the same battle will be online very soon and will advise you about the specifics of your situation.

You're his mother and no amount of money on her part gives your mother-in-law the right to assume care for your son. She's wrong. You're a good mother and have provided the two of you with a nice home and lots of love and care.

I'm sure others will be able to put your mind at rest as the day progresses, so watch this thread.

Mitchum xx
