My Ex and i still live in the same house. She says she cant get a mortgage until she has had 6 months worth of child maintenance going into her bank account. She is on benefits as she doesn't work, because of our disabled daughter (although she does work full time for a volunatry group,i'm still struggling to work that one out). Says she don't work, can't work and won't work!!. that's just a load of bull....

Anyway, does anyone know the legal side to this. Paying maintenance whilst still living in the same house (with the children of course)?. Does this count as the children spending nights with me, until she finds another house and moves out with the kids?.

Am, i being stupid agreeing to this?.

if you are separated, I don't see the problem - if she's claiming benefits as a single person she should be living as such, not doing your washing or cooking etc.

As for the mortgage side of it, it is likely she's been told that unless a mortgage company can see regular child maintenance payments going into her accounts, maintenanace can't be relied upon as income. I know this was an issue for me when it came to trying to get a mortgage as ex hadn't paid for 12 months.

I agree with the mortgage company bit and i understand that.

Whilst we are still living in the same house (family home) she is not claiming benefits. She receives DLA for our daughter and the regular child benefit, but other than that nothing at the moment. She hasn't apllied for tax credits or anything like that yet, so we continue to live of my salary (i.e all as if we were still together). Guess that doesn't change anything does it??.
