How Do I Enforce Consent Order Payments?

Consent Order signed in Oct 2010 said both parties to pay 50% of school fees each until children reach 11yrs old in 2012 & 2014. My Ex. has not paid next terms fees. He does not reply to any calls, texts or emails from me (since December 2010) and ignores all correspondence from the school.

What do I do next? I can not bear to start paying solicitors again; it took 2.5yrs and cost £40,000 to even get the wretched Consent Order! Can I just go to a court myself and tell the clerk he is not abiding by the terms of the Consent Order and they will "summons" him?

Mindy you can enforce the order yourself or the other option is to ask a solicitor to do it on the basis that the other side pay your costs for failing to comply with the terms of the order.

Write to your ex and state that unless the order is complied with you will file an on notice application with court and seek your costs.Give the ex 14 days to respond.

Even if you intend to do this yourself it does not hurt to let him/her know costs can be ordered for non compliance of the terms of the order.

If you do decide to do this yourself shout and the wiki`s will explain what you need to do.

For now write and send recorded and keep a copy of what you send.

Thanks! I doubt he will respond as his latest tactic is to ignore absolutely everything (including the children who he stopped seeing without warning in mid-January).

Assuming he doesn't respond, do I just go along to my local county court to lodge the D11? My divorce was granted in the Principal Registry in London.
