my boyfriends wife left him two years ago and doesn't pay child support. her reason is that he has a girlfriend ie me, who he can share bills with, which by the way, isn't true because i don't live with him. when they go to court will this affect her entitlements to anything in the divorce?

With regard to child maintenance, its very simple really, the Parent With Care gets a payment from the Non Resident Parent, this is set out by the CSA and their calculation takes no account for income of the PWC. The fact that you may or may not be sharing bills with my is irrelevant with regard to Child Maintenance.

Your new partner should claim child support through the CSA. Child maintenance is treated separately from the settlement of capital and these days usually the CSA has jurisdiction over CM rather than the courts.
