Hi - Are they likely to check with my company if a bonus payment has been made in the last 52 weeks?

They asked for my ex's end of yr statement from HMRC. Is that a p60?

Does the ex know about the bonus? If so, best you mention it otherwise you look like you are trying to hide it. (not that I think it matters!)

I think it would be included as it would make a huge difference to the outcome if it was a large payment.

Statutory redundancy payments aren't considered income for child support purposes but contractual redundancy payments are.

Usually child support is based on the average historical income but if circumstances change and someone becomes unemployed the CSA will recalculate the amount accrding to the actual income.

Hi There,

In the past (before I got residency) I was a NRP and paid via the CSA following a totaly breakdown of a volentary arrangement and fraudlent claims of non payment by my ex.

I declared everything from the start (including a small one off bonus). I was told that they only required proof of earnings from the previous 3 months pay slips when calculating my payments.

At the time of your bonus you had shared custody with the children staying with you so payments were not being made.

My understanding is the CSA are only interested in the situation moving forward, past wages are used to guage a payment level. If you explain that your earnings for the past 12 months would appear artificially inflated by this bonus and can provide for example the last 5 months payslips showing a consistant pay level plus show the slip with the bonus on there (hopefully your employer marked it as such on your payslip?) I believe you would have a fair case. (I am not a legal expert, just a parent).

You could also inform them (and make sure they record it on your file) that if you recieve a similar bonus in the future (although non is currently expected) of course you would declare it to them immediately and adjust that months payment accordingly.

Hopefully in the interim you will get the court case sorted out and the arrangements for your kids will return to the normal status quo.
