I understand that when calculating payments the CSA take pension contributions into consideration. My ex voluntarily pays extra into his pension to top it up - now the CSA payments I receive have gone down - is this fair???

Whether or not it''s fair is open to debate and each case will be individual. However it is allowed.

If it involves large amounts of money you might possibly be able to get a departure for diversion of income but it is unlikely.

OK thank you I was receiving £130 a week as my ex is a huge wage earner but due to the extra top ups I now receive £30 a week! Just seems unfair?

Now that sounds like diversion of income!

Assume it is a CS2 case? He would need to be paying £100s per week more into his pension than he was before to achieve that.

How long was he paying the £130 for? How many children are invoved?

There is only 1 child and he''s been paying £130 for 18 months - I''m not sure what CS2 is? and he is paying a lot extra weekly to top up.

CS2 is the post 2003 scheme so if your case opened after 2003 that is what you are on.

It would appear that he is a very high earner is there any possibility that anything else has changed to make his income go down?

How many overnights does he have child per week?

No I''ve seen the wage slips so I know that''s what he''s doing - the child is 16 and due to reasons he doesn''t stay overnight or see him much - that''s my son''s choice.
