I have a court order that reads:
As from the 1st day of June 2002 the Respondent do pay the Petitioner for the benefit of the children of the family (child one dob etc. and child two dob etc) at the rate of £250 per child, per calendar month, payable in advance until each respective child attains the age of 17 years or ceased full time education for a trade, training or profession.

My youngest who is now 21 has told me she is now finished Uni until September 2014 as she is on a work placement from Uni where she will be earning £7 per hour for a 35 hour week. Do I still have to continue paying my ex maintenance?

Thanks in advance.

Yes sorry, I was interrupted when responding and hit submit by mistake, the clause is very clear, once the kids are working no CM is required, in fact for some time you could have asked for a CSA assessment rather than stick to the order, long story short you are not required to continue, of course in the real world the kids will still need help, but how much and when is now for you to decide rather than by order of court.

So once my daughter returns to Uni in September 2014 I commence the payments again?

Can I just clarify, that being in a work placement from Uni for 1 year is not classed as being at Uni?

A work placement even when linked to uni is still a work placement, the education element for the purpose of the order has ended.

The order is a bit wooly, but if put before a judge they usually accept that once the first under grad degree is completed the education has ended in terms of CM.
