Child now living with father

Hi, My partner is divorced and his only child has been living with the mother. A Consent Order was issued when their divorce was finalised and it was agreed that the his Ex would receive weekly payments of £100 for the `benefit` of their daughter. He has been paying this amount without fail ever since. The agreement between him and his ex was that their daughter would stay with him every weekend and every school holiday. Again this has been done year after year.

Earlier this year, his daughter who is now 12 had a major falling out with her mother and she has been staying with her dad. A month ago he decided to stop the £100 per weekly payments to the mother. She in turn had a court notice issued to him for him to resume payments.

His daughter is very settled living with her dad and is making no headway to move back with her mother.

My question is, can he stop payments again in light of his daughter now living with him ?

Any advice, pointers would be appreciated.

Has court order been in place more than 12 months?

If so just go to CSA and ask them to assess for the new circumstances so that the child maintenance is flowing in the right direction.

Thanks, yes Court Order was in 2007.

Will advise he goes to CSA.
