Hello

My ex-wife is from abroad, came over on a spouse visa. left me within one year ( a few weeks after the birth of our daughter), so did not fulfil criteria for "indefinite leave to remain visa".
I then divorced her (legally) in the country we married, and served the divorce.

She has now applied for judicial separation and ancilliary relief.

We lived in my parents house, i have no assets/savings, and now am unemployed, on job seekers allowance.

At the first directions hearing, my ex's sol asked the judge for £5/week to be paid - this is because IF she was a uk national, she could apply to ths CSA, and as i am on JSA,, i would be paying £5/week.

----My arguement is that she is not eligible for help from the CSA so why should the judge order payment?

----second, is the judges order enforcable, ie do i have to pay, and what would be the effect of not paying?

thanks.
