I have 3 kids aged 1,4,5 and they were living with their mother till recently were taken away from her by the social services. I am portuguese and I am getting married in Portugal and have another child on the way. My question is if they will let me have my kids and bring them to Portugal so I can start my life there with them and my future wife?

do you have sole custody as if you do there should be no problem with you moving the children abroad i would seek legal advise though as you don't want to be sent back.

HI! Mine are different circumstances to yours, as my partner is opposed to my moving abroad, but after speaking to a solicitor today, I should have no problems when she petitions for me to remove my child from jurisdiction. She said it would be against a human right to prevent me moving. She said the only way it can be prevented is if it's going to be harmful to my little one. My ex and I will be going to court over this move, but she was very confident it would be ruled in my favour to permit the move. I can't see it being as hard for you since your children were removed from the person who could argue against you moving. Good luck!

Has the local authority gone to court in respect of the children is there a court order in place i.e. interim care order or has she agreed to them being in care voluntarily ?

If social services are applying for care proceedings for the children then you should be contacted in respect of you joining the care proceedings, if your not sure i would contact the childrens social worker to clarify this.

You can apply to join the proceedings and put yourself forward to be asessed with your new partner regarding the long term future of the children, you should get legal advice to discuss this further.
