hi
i am going to a finding of fact hearing on tuesday re contact order

can a court in england make a finding of fact on an allegation of assault in greece?

are the following actually 'allegations'?

driving recklessly

spoke innapropriately to a child aged 6 on the phone from abroad enquiring whether she had a boyfriend and telling the child not to mention the conversation to my ex who was with her. (i didnt by the way)

touched hair and neck of child aged 8yrs who is friend of family

i wanted to remain in bathroom while ex was bathing a 5yr old boy after ex said it was innapropriate causing an argument.(she wasnt bathing the boy anyway but whatever!!)

thanks

Evan,

A finding in fact is just that...a finding based upon evidence/witness/fact. An allegation is hearsay until proven or otherwise. An allegation can be made about anything...even the colour of grass...proving the allegation is where fact/evidence/witness is required for finding(s) in fact to be held.

morning and thanks for your reply....

do you or anyone know the answer regarding my ex's allegation of assaulting her abroad?

i dont see how an english family court can decide on something that happened in greece, is it in their jurisdiction?

i like that word for a sunday morning.

so will i need my spiderman outfit after tuesday or will the court be fair and sensible to a good dad who loves misses his daughter?!?

They may well be allegations and even be true but that doesn't make them evidence of abuse. ;)
