Application for fee remission

Hi,

I'm partitioning for divorce following my husbands affair. We have two children who live with me & I work part time (14.5 hrs per wk).

My solicitor sent my petition to court for issue but I have received a letter saying there had been difficulties with regard to Fee Exemption form. It says I must make an application under concession 3 (section 5)& that they require proof of housing costs. At present I'm living in our home and paying all the bills. I only work part time, & my ex currently pays the mortgage. Do I include the cost of my mortgage if I'm not paying it - even though I'm paying everything else. I can put my fixed allowances down (two dependant children & general living exp) but not sure about Housing costs??

Also If I'm not entitled to fee remission how much will i have to pay. I have very little disposible income & not sure how I'll be able to pay.

I think I read on here it costs £300.

The form your solicitor has sent is EX160 you can read it at HMCS site,

The application fees are £300 for the petition and £40 for the absolute assuming you can agree all matters.

I had the same letter come back from the court, I had to prove housing costs, but like you that was the only bill I didnt pay, so my solicitor said I couldn't put anything down.

I forget which concession I came under on the court forms, but I work part time, and with all the bills, childcare etc I had to pay £45 towards the £300 application fee.
