My husband has applied to court for Clean Break financial settlement. (Quite unnecessary in my opinion as our finances are relatively simple - but I digress).

We have been married for nearly 25 years and he has a substantial pension. I have a pension which will not be as large as I have only paid in to it for a few years.

On Form A he didn't tick the box to apply to court for 'a pension sharing order', only ticking 'lump sum order' and 'property adjustment order'.

Obviously, I believe we should be sharing everything that we have accrued throughout our time together.

Will not ticking the box matter? He will have to include the CEV on his form E anyway and surely the judge will look at the bigger picture regardless.

It may seem unnecessary now but actually is a really good idea for both of you. Everyone should get a clan break order even if they have no assets just to severe ties and stop the worry and risk of an ex resurfacing years later and making a financial claim.

You'll both have to make full financial disclosure and everything will be in the pot for division regardless of whether it is in joint names or just one of your names.

Thank you so much for taking the time to reply. I think my post wasn't very clear. I absolutely agree we need a clean break, but meant we ought to have been able to agree through mediation and a Consent Order, rather than the cost and stress of court.

My question was really about the fact that he didn't tick the pension sharing box on the form A, even though we both have pensions which will need to be shared (his is 10x the value of mine).

He hasn't filled the form out correctly so will that make any difference? I assume not.
