Afternoon

I am completing Form A 'Notice of a financial application...'.

I want to ask the Court to make a Clean Break order (my ex won't agree or discuss finances). We have one child but I do not want to claim any child maintenance.

When completing the form where it says 'Nature of application' (page 1) do I tick that I want 'to apply to the Court for'? Then do I tick 'a lump sum order'. Should I also tick 'a settlement or a transfer of property for the benefit of the child(ten)' just in case?

Under Section 1.'Further details of the financial application' do I leave this section blank?

Any help would be appreciated.

Hi, what you are asking for will depend on what assets there are and your needs, especially if there is a child or children involved. The most usual ones to tick are property adjustment, lump sum and pension sharing. This assumes you are applying to court for settlement and have not got an agreement. The same form is used for a Consent Order but you dont need to tick those boxes, just one to say you want a Consent order. The fee is different too.

For a consent order you need to send a copy of the draft order and a D81 statement of information that you have both completed and signed.

It is a good idea to get legal advice on any agreement to make sure it is fair. You should also get the consent order drawn up by a solicitor so it is legally watertight. If you need help, we have some fixed price services that could be useful. Give the helpline a call 01202 80 50 20.

Child maintenance is a statutory requirement so has to be paid by law. It is dealt with by CMS, not the courts.
