Hi,

Just found out that stbx took over £2.5k out of joint account in cash over last 3 months we were together. (I had been ill so he was looking after our finances).

We usually paid our credit card off each month and of course (!) for the last 3 months we didnt. He is now saying that the credit card debt of £3600 is jointly mine (yes - the spend was jointly mine but we would normally have paid it off!)

He has transferred the credit card to a 0% card in his name only.

Will any of this be taken into account when dividing assets/debt?

He is also building up more debt on his credit cards whilst I am living on what I earn.....will his new debt be taken into account when splitting the asset value?

the courts usually look at the figures when you both seperated, saying that in most cases if the costs incurred on the credit cards were for living expenses these will usually be taken off the final settlement figure, unfair i know but that is the way they look at it.
you would have to prove that the 2.5k he took out was not used on living expenses, that is very often hard to do as he took it out in cash and can make up various excuses where it went.
