Hi, I'm saperated and not living with my partner from October 2014. As soon as I left our house which we use to rent, I wanted to come back and see kids. She didnt let me see kids for about an year despite me trying hard to negotiate terms with her. I had to end up in court for children proceedings. She got legal aid on the basis that she is a single mother, she mentioned about domestic violence & even called police on me several times. Despite police been called on me I was never charged as there was no domestic violence proven.

So i had to end up spending around 25 thousand pounds in court to get a court order just to see my kids. Now that I decided to apply for divorce , she is giving me hard time once again.

I recently applied for divorce by sending the divorce petition. Her solicitor responded by saying that she already sent a divorce petition previously to the court in 2015 and therefore they will be contacting the court to ascertain weather the petition was ever issued.

They even said that my ex is seeking a financial settelment in the light of the marriage and they are asking me if I confirm weather I am willing to engage in full and frank disclosure, by way of exchange of financial statements.

Can someone guide me how do i respond to it and proceed without solicitors help as I cant afford to take solicitors on board.

Thanks

Welcome to Wikivorce.

It is standard practice for parties in a divorce to exchange financial information - if no information is shared then neither party is in a position to be able to make a sensible and fair offer in respect of a financial settlement.

It would be a good idea for you to read the guide to financial settlements - you can access it here - www.wikivorce.com/divorce/financial-settlements.html

As for the divorce petition, if one has already been submitted then it is correct that the first step is to establish if it is "live" or if it was in fact never processed by the divorce centre. You may find it helpful to read our guide to the divorce process - www.wikivorce.com/divorce/Guides-Divorce...-Initial-Checks.html
