Hi all,

My wife and I have agreed to divorce on amicable terms. We've agreed verbally how we'd like to divide things up as it's not too difficult (no children, house goes 50/50).

We have yet to agree on divorce terms, i.e. 2 year separation or quickie on basis of unreasonable behaviour. We're not in too much hurry to agree the divorce plan, but we both want to set the financials down now whilst things are amicable.

If we complete a Consent Order (e.g. the one sold on WikiVorce) and get this approved do we have to file for divorce now or can we still wait for the 2 year separation to happen?

You will not be able to get the consent order sealed by the courts until you have the Decree Nisi.

Sorry

You may be able to do a seperation agreement, but these are not always adhered to by the courts if your divorce goes that way.

The consent order is not binding untill the Absolute is decreed, also you would need to complete form D81 which is a snapshot of your financials so the judge can see what you have agreed is fair to both.
