Hello, I'm the respondent in a DIY divorce and have received the Petition, D8 and D10.

The divorce will not be defended and we have agreed on a settlement figure lump sum for me to pay my stbx wife. No kids involved, unreasonable behaviour is being used as it's the only one that fits.

The Petition looks fine to me - although there is nothing crossed out in the Ancillary Relief section but I've read this is normal practice anyway?

Wondered if any of you kind people could answer the following quick questions I have about the D10 please before I return it?

1) For question 5, there is no adultery involved in the divorce so do I just write "Not applicable"?

2) For question 6, she has agreed to pay the DIY divorce costs and the £300 court fee, so do I write "Not applicable" and then for what grounds say "Petitioner has agreed to pay costs of proceedings"? Btw on the petition Prayer section, (2) Costs has been crossed out, so she is not claiming costs - or is that referring to legal costs rather than the court fee?

3) For question 7, there are no kids involved so do I put "Not applicable" for (a), (b) and (c)? I have been given no Statement of Arrangements, probably for this reason.

4) For question 8 about polygamous marriage, this also does not apply so I guess I just put "Not applicable" again?

I will just cross out section 9(b), as I will be signing section 9(a).

Much appreciated, thanks :)

Sign 9b leave 9a alone

Write N/A to all those that don`t apply

No children so no statement of arrangements

It is common not to cross out any of prayer

This is a completed D10 to help,

Thanks for the quick reply and advice. That completed D10 is really useful.

My only query with what you said is that the example D10 on the link, and also the wording on the D10 I have in front of me suggests I have to sign 9(a) and not 9(b) as I am acting on my own in this DIY divorce, not using a solicitor. The D10 says:
'9(a) You must complete this part if
- you answered Yes to Q5
or
- you answered Yes to Q7(c)
or
- you do not have a solicitor acting for you'

9(b) asks about solicitor details etc

Just need some advice now for how to answer about the costs in question 6 if she has ageed to pay them - details in original post above.

I've read that for cases of UB, often the court will ask the respondent to pay?

Thanks :)

Hi Humpty yup i made a mistake:(

Your answers to 5 and 7 a-b-c should be N/A so don`t worry about 9a

Qu 6 is no costs are agreed

for details of solicitor put LIP (your doing it yourself) and your home address for service.
