I was granted Decree Nisi back in Feb 09, and have been trying to complete the Consent Order over the last few months. Trouble is, my ex is very bitter and her emotions go up and down - at times she is fine, at other, she is obstuctive. I have a new partner and just want to move on. There are children involved, a family home and pensions to deal with, bit my ex is enjoying stalling the process. Question is: Can I apply for Decree Absolute before finally agreeing the Clean Break? Also, what if she refuses to comply? Is my only option going the court with the inevitable costs of 1000s I can't afford?)

Any advice gratefully received!

The divorce and finances are separate so yes you can apply for the Absolute with out agreeing the money side (form D36 and £40 to HMCS) the standard advice is to agree the money side first and have the consent order sealed before applying for the absolute as your legal status changes upon Absolute.

Have you thought of mediation to help agree the money part, it can be very helpful, if that fails and you cannot agree then court is the last resort and yes it can be very expensive indeed. :(
