Any idears:(In England)

We just handed out form D8today. (undefended divorce, 10 years marriage, no childen)

My husband is willing to transfer me the money we agreed in advanced to help me to prepare my new life as soon as possible while we are waiting for the divorce proceding.

But, of course I can understand his concern about I might ask for more later, is there any way we can do to transfer money to me with protection on him before divorce is finalized?

Hi Hsiu

I am in a similar situation in that I also need access to funds of the pending settlement in order to put down on a deposit on my new home.

As the divorce is only in its infancy it's unlikely that the Consent Order will be ready in time to complete on my new home.

From what I have read and been informed there is no legal way to do this in advance and until the courts sign the consent form there is alway a comeback on any agreement between the parties.

I guess it comes down to having trust each other - which sadly in my case is not easy to do given that trust is the reason (adultery on his behalf) that our marriage broke down!

I also have fund that "no way" and I have to accept it and wait for the consent order to be signed. Another discovery is it will take" 2 weeks for respondent reply + 1 week for Decree Nisi + 2 weeks for consent order to be signed + 1 week for bank transfer notice + some weekedns" totally at least 7 weeks to get the money, if I am right?! should they make divorce as faster as marry, help people to start new lives asap to recover from the heart-broken marriage?

I think a seperation agreement holds some weight if you both have had legal advice and are aware of each others financial details. Not water tight by any means but if a solicitor draws it up and it is worded correctly it will have some merit.
