Hi,

My wife and i have been seperated for over a year now.
We have sold the family house and divided the assets.
We have agreed a monthly maintenance payment for our two children and also access, overnights etc.
She has agreed to stating she has comitted adultery as the reason for me wanting the divorce.

Now the next step is to get divorced. So with our current situation, is the best option to use a diy divorce service? Also is it worth taking out a Consent Order as well or is there a danger that a judge could step in and disagree with what we have agreed between ourselves..?

This is my final hurdle and we have both worked emotionally hard to get where we are now..any advice would be greatly appreciated.

Hello

If you both agree all matters (and well done for that) you can use DIY or a managed service the advantage of the managed service is they deal with it all from start to finish.

To finalise the financial side you should have a consent order without one its left up in the air and can become complicated later on if there is a disagreement.

The judge who reads the consent order is not looking to cause problems or delay the order just to make sure you both understand the agreement and that overall its fair for both of you and the children, if the judge does have questions they will write or ask you both to a short hearing then the order is usually sealed.
