I already have a Residence order, do I need a D8a?

Hi,

I'm in a bit of a pickle, I have already got a Residence order for my daughter and I am about to put in the initial Divorce paperwork (D8 & D8a).
I have 2 questions though:

1) Do I actually need to submit a D8a if I already have a Residence order (I only ask as it is mentioned in the D8 that I already have one under Q7)?

2) My wife and I separated in July 2006, I am now in a new relationship and have been for almost 3 years.
My current partner and I have a child together now and I am a bit confused with what I need to put down for Q6 on the D8 form. Any ideas? :S

You do need to complete the D8a, as its purpose is to allow the Judge dealing with the divorce to see what the arrangments are.

You put the names of your daughter in the part that says "Children of both parties" and your child with your new partner in the 3rd box on that same page which is headed "children who are not children of the family"
