Petition - Will I have to pay again?

Hi

I am about to send off today the divorce petition and statement of arrangements to the courts.

As there are no financial matters to be sorted I have completed everything myself (with thorough use of guidance notes) and hope this will be a cheap and straightforward process.

If by any chance I have completely messed up the forms will I have to pay another fee of £340 to the courts to resubmit? If ex decides he wants to amend anything (I offered for him to see copy before it gets sent but he has chosen to ignore me), what happens then?

I have email from ex saying he is eager for divorce to get started so sure he won't contest and everything about the arrangements for children is fair and true.

Just worried about the money side of things.

If you make a mistake on the Petition they just send it back to amend, some courts sent the cheque back which is a bit of a pain.

Your ex has refused your offer to send it for approval so if he does want to have it amended you can either do it or inform court he refused at the outset.

So no you wont have to pay again if you have made a mistake, to prevent any problems when you take it to court ask them to check its correct.

Thanks, that's put my mind at rest.

He hasn't refused - he just hasn't replied. He also said he was going to pay half (got it confirmed in email) but despite asking for his share 3 times he hasn't stumped up - just ignores me.

Probably burying his head in the sand or using it as a control tactic as he knows I am skint and was relying on his half.

Can't be bothered with playing games so getting on with it anyway!

Thanks again - will be at Post Office lunchtime waving it goodbye.

If he does just ignore it then you will need to have it delivered to him by a process server, if you look at the orange adds on the right there are a couple who can do this for you, it does cost around £80-£120 but it gives court proof the Petition was served which allows court to continue the divorce process without his signature.
