Can you have a consent order with out a Divorce

I want to get the financial side sorted as quickly as possible as I want to move on with my life. At the moment my wife live at the house, while I rent. We are in agreement over everything financial and do not have children.

Can I apply for a separation Consent Order without filing for Divorce?

You can't have a consent order, but you could enter into a deed of separation, and agree to then confirm this with an order as/when you do get divorced.

If you wish, the separation deed could include agreement as to when you would start divorce proceedigns and on what basis (e.g. agreeing to divorce once you have ben separated for 2 years)

It will depend a lot on how complex it is.

normally a deed would set out what financial arrangments had been agreed, and would include a summary of the financial position you are both in.

If you are able to provide all relvenet details when you instruct a solicitor (incuding things suich as values of the various assets, mortgage account number / policy number / account numbers of any assets being split of transferred etc then it will bmake it easier for the solicitor to draft the agreement.

A lot of solicitors offer an initial free appointment so it may be sensible for you to see someone on that bassis and to make inquiries about likely costs - it will depend on the normal hourly rate the solicitor you see charges.

I am sure, also, that there are places on the internet which will offer to do ti for you and will charge less than a solicitor. I can't say for certain that there arent places out there which will do a good job but I persoanlly have seen a number of deeds preapred by internet firms all of which had major faults and errors in them, so proceed with caution!

I used an online service for my Separation Agreement (separation- agreement.co.uk) - even though I bought their solicitor-managed package they made several errors and even tried to charge me to correct them!

Luckily for me the agreement was only so that my mother-in-law had something in writing as she was lending my stbx the money to buy me out, but had I been relying on it myself it I would have had no confidence in it whatsoever.

I would be inclined to go with TBagpuss's advice.
