Hello.
I am helping a friend who has the court forms for her divorce.
She is using unreasonable behavior for her divorce.
The only problem we are having is that she separated from her husband 11 months ago and they have just recently sold their house, they are both moving into separate rented properties when the house sale is complete in a week or two.
She does not want to wait 2 years to divorce.
As we understand, she has to claim UB in the past 6 months which is not a problem but will the fact they will not be living together when the court papers are taken to the court cause any problems?
Sorry to sound a bit thick :P It just seems funny to say you can no longer live with someone when you have already moved out!!!

What matters is that the UB took place in the six months before separation. If you stay longer than six months that is taken to imply that you can put up with it. But as they separated she should be OK.

Thanks for the quick reply sadie, she left the marital home but went back to sell and has been sleeping on the sofa for months, they have not been living together as man and wife.
