EX-PARTE APPLICATION FOR AN ORDER DEEMED SERVED ON ME (RESPONDENT).

I am relatively new to this and unable to fund a solicitor as all my money and more (debts mounting) are going to the X and the kids upkeep. I am getting in more arrears everyday as we are living beyond our means.

I have already been to court where my 'X' had her solicitor and I was by myself.

This was the first hearing where the judge checked what answers were reasonable by both parties but he did not have my questionaire and other forms to hand.


I have now since received paperwork from the court sent out on the 31st Dec(post-marked) and recieved Friday the 7th Jan.

It says :
'Before District Judge #### sitting at Watford County Court, on 22nd Dec.
On Petitioner without notice application attached
IT OS ORDERED THAT

The Petition is deemed served on the respondent'

This has been stamped by the court.

The next pages relate to EX-PARTE APPLICATION from X.
The points are:
1) divorce petition is deemed served upon me(the respondent).

2) that the respondent pays the cost of an incidental to this application.

There is an affidavit from 'X' dated the 17th Nov..

The affidavit has several points basically trying to prove that I do not care "His failure to respond is indicative of his attitude towards the proceeding'

In fact the truth is I am fumbling along not knowing what to do next.

Please help - I am really messed up.

I work literally 7 days a week from early am till late pm.

CEB all this means is a judge has decided the divorce to go ahead without you singing the divorce Petition, this happens because you either refused to sign or they were unable to catch up with you.

You will have to pay the costs for this, you need to make sure you respond to any other letters from court or you will get into trouble.
