So, as expected, X2B hasn't paid the divorce costs as set out in the court order we received post Ancillary Relief. I've sent him two letters requesting payment, the last one via recorded delivery giving him 14 days to start paying.

I intend to use Money Claim Online if he doesn't and have warned him that if I do have to take action against him in this matter, he will have to pay all fees relating to it.

When I make the claim (I'm 99% certain he'll choose to ignore my letter, as he's ignored all my other attempts at communicating with him over the past year and more), will Money Claim Online automatically add the cost of the action to the claim? Or should I manually add this amount (£60) to the amount the court ordered him to pay when I fill in the claim details online?

I haven't actually gone through the process yet so don't know if there's a ticky-box for adding costs to the claim or whatever. Any help from someone with more experience of using Money Claim Online would be very gratefully received. :-)

In other news, I just rang the court to find out what's happened to my Decree Absolute and was told that I am in fact officially divorced and will be receiving my Decree in the post shortly. HURRAH!!! :woohoo: :woohoo: :woohoo:

You pay MCO the fee and they then retrieve it when collecting the debt and give it back to you.

The forms are nice and easy to complete but you will have to send a hard copy of the order by post to Northampton county court who deal with the claims.

Excellent stuff, thanks loads for that info Dukey. I'll bear in mind needing to send off a hard copy, not too onerous but I guess there'll be deadlines to get it sent by.

I have another question though - is the only option through MCO to collect the debt all in one go? X2B is currently (as far as I'm aware) unemployed and I did originally give him the option of paying in installments (£5/wk as per CSA payment guidelines). It'll be a bit difficult for MCO to get all the money off him at once - how do they deal with that sort of situation?


Thanks for the congrats - technically I'm 'Divorced' and 'In a Relationship' (I know, greedy moo!) rather than single as I have a new (and very lovely) partner. I never know what to put on insurance forms etc. when they ask my marital status as so many different options apply... :P

I only know of collection of the full debt WC but if you call them 0845 601 5935 i`m sure they will answer very quickly.

I am Dukey, thank-you. :-) Ta for the number too, I'll get in touch with them and find out the ins and outs before I start my claim. Of course there's still part of me hoping that X2B will see how stupid he's being and start repaying me before the deadline I've given him, but previous experience suggests he'll just do as he's always done and pretend he's an ostrich...
