hi,

I'm using an internet company for the administration of my divorce and have just received form D79 stating that the judge has refused to grant the degree nici on the grounds that I didn't provide satisfactory evidence of 12 months residency before the petition (section 3i). The internet people said that the forms were correct and that i would have to contact the court to find out what the problem was and what evidence was needed.

I finally managed to drag out of the clerk that there was a problem with the initial petition - that section 3 had not been correctly written. Considering that the internet people had written out the petition I feel that they are to blame for any error. I checked the model sentences for section 3 and the ONLY difference is that they seem to have omitted to put 'and' between 'England' and 'Wales'. I was told that I'd have to either go to the court itself (a little difficult as I'm living abroad) to do something or resubmit the affadavit. I'm now left feeling very confused about what to do as the internet people refuse to reply to my queries and the court wasn't exactly clear.

Any ideas on what to do now?

Hi Tami

I am sorry you internet service provider is refusing to assist you with this.

Unfortunately without sight of all the documents I can not be much help.

If you would like to send the documents all through to us at

thanks Amanda for your advice. I've just been told by the courts that since I'm currently living and working in France, but my ex is in England then none of the model paragraphs for section 3 on the petition seem to be valid - i've contacted the ISP for advice - though if they don't get back with anything satisfactory within 48 hours i'll take up your offer! Will you charge for this, and how much if so.

Thanks
